To receive apologies for absence from Members to determine the quorum of the meeting in accordance with Rule 7 of Part 4 of the Constitution.

An apology for absence was received from Councillors J Kaufman and R E R Morris.

To appoint substitute Members in accordance with Rule 26 of Part 4 of the Constitution and the Substitution Procedure Rules.

None.

Members are reminded that any declaration of interest should be made having regard to the Members’ Code of Conduct. In particular, Members must make clear the nature of the interest and whether it is 'pecuniary' or ‘non-pecuniary'.

Councillor Miss P V Joshi declared a non-pecuniary interest with regard to application no. 19/00216/COU (Unit C, 15 Mandervell Road, Oadby) insofar as her son is a member of the gymnasium.

Councillor Mrs H E Loydall declared a non-pecuniary interest with regard to application no. 19/00354/VAC (Freer Community Centre, Wigston) insofar as her husband and fellow Member approached one of the group leaders who use the Community Centre.

Both Members confirmed that they attended the meeting with an open mind and without prejudice.

To read, confirm and sign the minutes of the previous meeting in accordance with Rule 19 of Part 4 of the Constitution.

UNANIMOUSLY RESOLVED THAT:

The minutes of the previous meeting held on 19 September 2019 be taken as read, confirmed and signed.

Report of the Development Control Manager and Relevant Planning Control Officer(s)

Ms C Grant spoken upon the application on behalf of the applicant.

The Committee gave consideration to the report (as set out at pages 5 - 19 of the agenda reports pack) which asked it to determine a planning application for a change of use from storage and distribution (Use Class B8) to a gym.

It was moved by Councillor Mrs H E Loydall, seconded by Councillor G A Boulter and

RESOLVED THAT:

(i)       The application be GRANTED planning permission in accordance with the submitted documents and plans subject to the prescribed conditions (as amended at (ii), (iii) and (iv) below);

(ii)     A condition be added such that the development permitted, and the conditions attached thereto, be personal to, ran and operated by Mr M Kazilionis of Evolution Fitness only and no other person(s);

(iii)   A condition be added such that within three months, the metal containers situated on the car park be removed in order to allow the parking provision to be provided; and

(iv)    A condition be added such that within four months, the parking and cycle storage spaces as well as the turning area be provided and thereafter maintained and retained.

The application be GRANTED planning permission in accordance with the submitted documents and plans subject to the prescribed conditions.

The Committee gave consideration to the report (as set out at pages 25 - 30 of the agenda reports pack) which asked it to determine a planning application for a variation of a condition relating to planning permission 18/00317/FUL.
